Terms of Use for Past Papers TZ
1. Acceptance of These Terms
These Terms of Use ("Terms") govern your access to and use of the Past Papers TZ mobile application (the "App"). By downloading, accessing, or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the App.
2. Description of the App
Past Papers TZ is an educational reference application that helps users browse, download, and read examination papers and related study materials. The App is independently developed and is not an official application of, affiliated with, endorsed by, or otherwise officially connected with the National Examinations Council of Tanzania (NECTA) or any other educational institution.
The App and its materials are provided for personal educational and informational purposes. The App is not a substitute for official examination information, current requirements, or guidance from NECTA or another relevant educational authority.
3. Your Use of the App
You may use the App for your personal, non-commercial learning and reference purposes. You agree to use the App lawfully and responsibly. You must not:
- Use the App for an unlawful, harmful, fraudulent, or infringing purpose.
- Copy, modify, distribute, sell, lease, or commercially exploit the App or its content except as permitted by law or by us in writing.
- Redistribute downloaded examination papers or other materials in a way that violates applicable copyright or other rights.
- Attempt to reverse engineer, decompile, disassemble, or otherwise derive the source code of the App.
- Interfere with the operation or security of the App or any service connected to it.
- Remove or alter any copyright, trademark, or other proprietary notices.
4. Intellectual Property
The App, including its software, design, text, graphics, and other original content, is owned by or licensed to us and is protected by applicable intellectual property laws. These Terms give you a limited, non-exclusive, non-transferable, revocable license to use the App for its intended purpose. No ownership rights are transferred to you.
Examination papers and related materials may be owned by or licensed to NECTA, other educational institutions, contributors, or other copyright holders. We do not claim ownership of those materials. Their availability in the App does not change any applicable copyright or other rights, and you are responsible for using them only as permitted by applicable law.
5. Third-Party Services and Advertising
The App may use or include third-party services such as Firebase Analytics, AdMob, and Google Play Billing. These services may collect information, display advertisements, or process transactions according to their own terms and privacy policies. We are not responsible for the availability, content, accuracy, or practices of third-party services.
Any purchases or subscriptions made through Google Play Billing are processed by the applicable app store and are subject to that store's terms, billing rules, cancellation terms, and refund policies.
6. Accuracy and Availability
We aim to keep the App useful and accurate, but examination papers, curricula, educational requirements, and other information may change. We do not guarantee that the content is complete, current, error-free, or suitable for every purpose. You are responsible for checking current official sources and complying with all applicable laws and examination requirements.
We may update, suspend, restrict, or discontinue any part of the App or its content at any time without notice.
7. Disclaimer of Warranties
To the fullest extent permitted by law, the App and its content are provided "as is" and "as available" without warranties of any kind, whether express or implied. We disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.
8. Limitation of Liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive loss or damage arising from or related to your use of, or inability to use, the App or its content. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
9. Termination
We may suspend or terminate your access to the App if you breach these Terms or if we need to do so to protect the App, our users, or our legal rights. You may stop using the App at any time by uninstalling it from your device.
10. Changes to These Terms
We may revise these Terms from time to time. Updated Terms will be posted on this page and will take effect when posted, unless a different effective date is stated. Your continued use of the App after changes are posted means that you accept the revised Terms.
11. Governing Law
These Terms are governed by the laws of the United Republic of Tanzania, unless applicable law requires otherwise. Any disputes will be subject to the jurisdiction of the appropriate courts, subject to any rights you may have under applicable law.
